1. INTRODUCTION AND ACCEPTANCE OF TERMS

Welcome to Boostpadi.

These Terms and Conditions of Service (“Terms”) govern your access to and use of the Boostpadi freelance marketplace, including its website, user accounts, freelancer profiles, employer accounts, job listings, service listings, messaging tools, project management features, payment facilities, and any related marketplace services.

Boostpadi is a digital freelance marketplace designed to connect independent professionals, freelancers, service providers, businesses, employers, entrepreneurs, and other clients seeking professional services.

For the purposes of these Terms, “Boostpadi”, “we”, “us”, or “our” refers to the legal entity that owns and operates the Boostpadi freelance marketplace, as identified above.

“User”, “you”, or “your” refers to any individual or legal entity that accesses, registers for, or uses the marketplace.

By creating an account, clicking an acceptance button, posting a job, submitting a proposal, purchasing a service, accepting a project, or otherwise using the marketplace, you acknowledge that you have read, understood, and agreed to these Terms.

If you do not agree to these Terms, you must not create an account or use the marketplace.

These Terms should be read together with our Privacy Policy, Cookie Policy, Community Guidelines, applicable payment terms, and any additional terms expressly incorporated into this agreement.

Where a specific project agreement conflicts with these Terms, the project agreement will govern the relationship between the relevant employer and freelancer for that project, except where doing so would conflict with applicable law or provisions of these Terms that expressly continue to apply.

4.2. Independent contracting relationship

Employers and freelancers are responsible for their own contractual relationship, including the agreed scope of work, deliverables, deadlines, pricing, professional standards, and applicable legal obligations.

Nothing in these Terms automatically creates an employment relationship, partnership, joint venture, agency, or fiduciary relationship between Boostpadi and a user.

The actual legal classification of a relationship will depend on the relevant facts and applicable law, regardless of the terminology used by the parties.

4.3. No guarantee of work or results

Boostpadi does not guarantee that:

a. A freelancer will receive job offers or earn a particular amount;

b. An employer will find a suitable freelancer;

c. A project will be completed within a particular period;

Users are responsible for assessing the suitability of their prospective counterparties.

Where reasonably practicable, material changes affecting paid services will be communicated to affected users.
